Skechers Injury Lawsuit Contends Shape-Ups’ Defects Cause Knee Injury

According to court documents, the plaintiff bought Shape-Ups in February 2011 after being persuaded by various ads that wearing these toning shoes could provide her with various health benefits. Namely, Skechers ads claimed that wearing Shape-Ups could help wearers get in shape and improve muscle tone in the legs, buttocks and abdominal muscles, as well as improve their circulation and posture.

The complaint further states, in less than six months after buying and regularly wearing Shape-Ups, the plaintiff was walking in her living room when the unstable rocker bottom of one of her shoes caused her to fall after one of her feet twisted inwards. The fall resulted in immediate, severe knee pain, which led the plaintiff to seek medical care. Upon undergoing an x-ray on her injured knee, the plaintiff was informed that she had torn the meniscus in left her knee. She was also informed at this time that she would need to undergo surgery.

Despite having knee surgery and undergoing extensive physical therapy following her surgery, the plaintiff still reportedly has limited use of and constant pain in her injured left knee.

Skechers Misleads Consumers about Shape-Ups’ Safety, Skechers Injury Lawsuits Allege
This Skechers injury lawsuit, as well as many other Shape-Ups lawsuits, alleges that Skechers has grossly overstated the safety and effectiveness of Shape-Ups and that Skechers’ claims about Shape-Ups’ health benefits have not been validated by reliable scientific research. This allegation has been supported by an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin, which found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf, June 2010]
