Foot Fractures Caused By Shape-Ups’ Dangerous Design, Alleges Skechers Lawsuit

The complaint for this Skechers lawsuit (Case No. 3:13-cv-00452-TBR) details how the plaintiff’s use of Shape-Ups caused her to develop serious foot injuries. According to court documents, the plaintiff bought her Shape-Ups in April 2011. Within about one month of regularly wearing her Shape-Ups, the plaintiff had been walking on a flat surface when the unstable rocker bottom of one of her shoes turned inwards, causing her to fall and suffer from excruciating foot pain.

Upon seeking medical attention and undergoing x-rays, the plaintiff was informed that she had fractured her foot in multiple places and that she would have to wear a boot for about two months. Once the boot was removed from her injured foot, the plaintiff also underwent extensive physical therapy. While the plaintiff lost three months of income because her Skechers foot injuries prevented her from being able to work, she also continues to have limited use of her injured foot due to these severe injuries.

The $40 Million Class-Action Skechers Lawsuit Settlement

In addition to alleging that Shape-Ups’ defective design caused the plaintiff’s serious injuries, this Skechers lawsuit also contends that the plaintiff had originally purchased Shape-Ups due to the alleged health benefits touted in the various ads for these toning shoes. Specifically, while Skechers ads claimed that wearing these shoes could improve muscle tone in the legs, buttocks and abdominal muscles, these ads also alleged that regularly wearing Shape-Ups could help consumers improve their circulation and posture.

However, as the complaint contends, Skechers’ claims about Shape-Ups’ health benefits have not been validated by reliable scientific research. Allegations that Skechers’ has overrepresented the safety and effectiveness of Shape-Ups’ have spurred thousands of lawsuits and have cost Skechers millions in settlements to consumers throughout the U.S. In fact, in May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on more than 500,000 consumer claims that Skechers intentionally misrepresented the health benefits of Shape-Ups in its advertising.
