Numerous Transvaginal Mesh Manufacturers Have Reportedly Entered Into Vaginal Mesh Lawsuit Settlement Talks To Settle Thousands Of Vaginal Mesh Lawsuits Filed On Behalf Of Women Who Allegedly Suffered Serious Transvaginal Mesh Complications.
As the litigation of transvaginal mesh lawsuits continues to grow, a report recently published by Bloomberg News has fueled speculation that potentially thousands of cases could be resolved soon, according to Wright & Schulte LLC. According to the report, C.R. Bard, Inc., Endo Health Solutions, Inc. (the parent of American Medical Systems, Inc.), Coloplast A/S, and Cook Medical, Inc., have entered into talks that could result in thousands of vaginal mesh lawsuit settlements involving devices used to treat pelvic organ prolapse and stress urinary incontinence. Plaintiffs’ attorneys have asked U.S. District Judge Joseph Goodwin, who is overseeing the litigations in the U.S. District Court, Southern District of West Virginia, to appoint a transvaginal mesh lawsuit settlement committee to oversee negotiations, Bloomberg News said.
Court documents indicate that more than 30,000 transvaginal mesh lawsuits have been filed in the litigations underway in West Virginia. These include:

• In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (MDL No. 2327)
• In Re: Coloplast Corp. Pelvic Support System Products Liability Litigation (MDL No. 2387)
• In Re Cook Medical, Inc., Pelvic Repair System Products Liability Litigation (MDL No. 2440)
According to Bloomberg News, only Ethicon Inc. is not involved in the reported settlement negotiations.
So far, court records indicate that device manufacturers have lost every vaginal mesh lawsuit that has gone to trial. In March of this year, a New Jersey Superior Court jury hearing the nation’s first trial of an Ethicon Inc. transvaginal mesh lawsuit awarded more than $11 million to a woman injured by the Gynecare Prolift device. (Gross v. Gynecare Inc., Atl-L-6966-10) In July 2012, C.R. Bard was ordered to pay $3.6 million to a woman injured by the company’s Avaulta mesh, following a trial in California Superior Court. (Scott v. Kannappan, S-1500-CV-266034-WDE). And most recently, C.R. Bard lost the very first case to go to trial in the federal litigation, with the jury awarding more than $2 million to another Avaulta mesh recipient.
According to an earlier Bloomberg News report, C.R. Bard settled two additional Avaulta mesh lawsuits following the loss in the federal trial.
Tens of thousands of women have received transvaginal mesh devices to repair pelvic organ prolapse and stress urinary incontinence. However, the U.S. Food & Drug Administration(FDA) has issued vaginal mesh complication warnings on two separate occasions, in October 2008 and 2011. According to the agency, the most frequently reported transvaginal mesh complications include mesh erosion and shrinkage, chronic pain, infection, and pain during sexual intercourse.
