With 38 AndroGel Lawsuits Alleging Strokes And Heart Attacks Due To The Testosterone Treatment Drug Pending In US Courts The JPML Will Hold A Hearing On May29th To Address A Motion To Consolidate The Testosterone Treatment Lawsuits

The JPML will consider the petition to transfer and consolidate 38 plus AndroGel lawsuits to the U.S. District Court, Northern District of Illinois for coordinated pretrial hearings. Court documents indicate that plaintiffs in AndroGel lawsuits filed a brief on March 28, 2014, requesting the JPML allow the coordination of 38 pending testosterone treatment complaints that all allege the low testosterone medication causes heart attacks, strokes and other cardiac problems. The lawsuits against Abbot Laboratories Inc. and AbbVie, Inc., the manufacturers of AndroGel, also allege that the prescription testosterone replacement medication is not safe and the defendants did not adequately warn consumers and health care providers about the serious health risks associated with using the product, which include heart attack, stroke, pulmonary embolism, deep vein thrombosis and thromboembolic events.

The motion to consolidate further states the AndroGel lawsuits have common questions of fact, such as whether the defendants knew or should have known about the personal injuries associated with using AndroGel and whether the defendants were negligent in marketing and promoting the low testosterone treatment medication. The brief also claims the defendants continue to market AndroGel without conducting any additional safety testing or issue additional warnings about the product.

According to court records, a similar motion has been filed asking the JPML to transfer and consolidate all testosterone treatment lawsuits to the U.S. District Court, Eastern District of Louisiana. The plaintiffs’ motion stated that there are 50 lawsuits filed across the country involving testosterone replacement therapy medications such as Androderm, AndroGel, Axiron, Delatestryl, Depo-Testosterone, Fortesta, Striant, Testim, and Testopel, and the complaints all allege that the prescription drugs cause heart attacks, strokes and other life-threatening side-effects. AndroGel is a prescription medication approved by the U.S. Food & Drug Administration (FDA) to treat hypogonadism in men who have low testosterone due to an underlying medical condition. Because of reports associated with AndroGel and other testosterone replacement therapy drugs, the FDA launched an investigation into these prescription medications. In its January 31, 2014, announcement, the FDA cited two studies that show men who used testosterone treatment therapy were at risk for having cardiovascular problems. One study the federal agency highlighted found that testosterone treatment medication increased the risk of heart attacks among older men and younger men with pre-existing heart conditions. A second study suggested that men who had an underlying cardiovascular disease had a 30 percent increased risk of stroke, heart attack and death.
