A Texas man has filed a Risperdal lawsuit against the makers of Risperdal and Invega alleging that he developed gynecomastia, the development of female breast tissue, from the medications, the Pennsylvania Record reports. The Risperdal lawsuit was filed in the Risperdal Litigation at the Philadelphia Court of Common Pleas and names Janssen Pharmaceuticals, Elsevier Inc., Johnson & Johnson Co., and Excerpta Medica Inc., as defendants. The lawsuit claims that besides the growth of breast tissue, the plaintiff also experienced pre-diabetes, weight gain, and suffered emotional and psychological injuries because of his use of Risperdal and/or Risperdal Consta from 2007 to 2011. The plaintiff then used Invega and/or Invega Sustenna from 2011 to now.
Risperdal is an anti-psychotic medication that is used to help treat bipolar disorder and schizophrenia. Invega is also used to as a treatment for certain psychiatric disorders.
Risperdal Lawsuit
The Risperdal lawsuit or Invega/Gynecomastia lawsuit accuses the defendants of fraud, negligence, breach of implied warranties, breach of express warranties, strict product liability, violations of the Pennsylvania Unfair Trade Practices law and Consumer Protection laws, as well as conspiracy. The Risperdal and Invega lawsuit seeks an unknown amount in punitive and compensatory damages.
J&J And Its Subsidiaries Fined $2.2 Billion, One Of The Largest Health Care Fraud Settlements
In recent news, J&J and its subsidiaries are paying $2.2 billion, one of the largest health care fraud settlements in the history of the country, over its marketing and promotion of Risperdal, Invega, and Natrecor, and physician kickbacks. The Department of Justice also reports that J&J subsidiary Janssen plead guilty to misbranding the antipsychotic drug Risperdal and promoting use of the drug as a treatment for anxiety, depression, agitation, confusion, and hostility in the elderly.
“The conduct at issue in this case jeopardized the health and safety of patients and damaged the public trust,” said Attorney General Eric Holder. “This multibillion-dollar resolution demonstrates the Justice Department’s firm commitment to preventing and combating all forms of health care fraud. And it proves our determination to hold accountable any corporation that breaks the law and enriches its bottom line at the expense of the American people,” the Department of Justice wrote in a news release.
