10 Stryker Hip Lawsuits Selected In New Jersey Litigation For Early Mediation. First Formal Mediation Session To Discuss Possible Stryker Hip Replacement Settlements To Take Place No Later Than December 15, 2013.
The Stryker hip lawsuit lawyers at Wright & Schulte LLC, an experienced medical device injury law firm, applaud the mediation plan recently unveiled in New Jersey Superior Court for Stryker hip lawsuits involving recalled Rejuvenate and ABG II Hip Stems. According to an August 12th Order issued by Superior Court Judge Brian R. Martinotti, 10 Stryker hip lawsuits have been selected for early mediation in the consolidated proceeding. The Order also states that the first mediation session to discuss possible Stryker hip replacement settlements will take place no later than December 15, 2013. According to Wright & Schulte LLC, if the mediation sessions lead to Stryker hip settlements in any of the 10 selected cases, additional settlement negotiations could be ordered in other claims. There is still time for alleged victims of the Stryker Rejuvenate and ABG II hip stem recall to file claims of their own. Wright & Schulte LLC is offering free Stryker hip replacement lawsuit consultations to individuals who suffered serious complications due to the recalled Stryker Rejuvenate and ABG II Modular-Neck Hip Stems, including:
- Tissue death
- Damage to bone and tissue
- Premature failure of the implant
- Loosening of implant
- Formation of pseudotumors
Some 20,000 Stryker Rejuvenate and ABG II hip stems were sold worldwide prior to the announcement of the Stryker hip replacement recall in July 2012. According to the Stryker hip recall notice, the metal hip stems are prone to fretting and corrosion at the modular-neck junction, which can lead to pain, swelling and adverse local tissue reactions related to metal debris shed from the device. According to court documents, plaintiffs who have filed Stryker hip implant lawsuits in the New Jersey litigation have suffered metallosis, necrosis, osteolysis and other serious complications, allegedly due to the defective nature of the Rejuveante and ABG II stems. According to their complaints, many of these patients have undergone revision surgery to have their failing Stryker hip removed, while others will likely need revision surgery in the future.
More than 300 Stryker hip lawsuits are now pending in the New Jersey litigation. Nearly 200 additional claims involving similar allegations have been filed in a multidistrict litigation underway in the U.S. District Court, District of Minnesota. Court documents indicate that the federal litigation’s initial conference has been scheduled for September 9, 2013.
