C8 Lawsuit Alleges Pollution From DuPont’s Washington Works Plant In Parkersburg, West Virginia, Caused Plaintiff To Suffer Thyroid Disease And Thyroid Cancer

The C8 lawsuit, which was filed on August 8, 2013, in U.S. District Court, Southern District of Ohio, further alleges that the Plaintiff was caused to sustain severe and permanent personal injuries, pain, suffering, and emotional distress due to DuPont’s negligence. C8 Lawsuits

C8 is a chemical used in the manufacture of Teflon, and was discharged from the Washington Works plant for decades. This latest C8 lawsuit filed by Wright & Schulte LLC is one of dozens of similar complaints pending in a multidistrict litigation established in the Southern District of Ohio for claims filed in accordance with the 2005 C8 class action lawsuit settlement. That accord, which DuPont reached with 70,000 people who lived and worked in the vicinity of the Washington Works facility, held that anyone who had been exposed to C8 contaminated water would be eligible to file a personal injury lawsuit if they developed a disease ultimately determined to be associated with C8 exposure. To qualify to file an individual C8 lawsuit, potential plaintiffs must have been diagnosed with a related diseased, and they must have lived in one of six water districts stipulated by the settlement prior to December 3, 2004. Those six water districts are:

  • Little Hocking, Ohio
  • Belpre, Ohio
  • Village of Pomeroy, Ohio
  • Tuppers Plains, Ohio
  • Lubeck Public Service District, West Virginia
  • Mason County Public Service District, West Virginia

In October 2012, the C8 Science Panel announced it had found probable links between the chemical and a number of disorders, including testicular and kidney cancers, pregnancy-induced hypertension (pre-eclampsia), thyroid disease, high cholesterol and inflammatory bowel disease.

According to court documents, the U.S. Judicial Panel on Multidistrict Litigation issued an order in April 2013 that transferred all federal C8 lawsuits alleging personal injury or wrongful death to the Southern District of Ohio for consolidated pretrial proceedings. Wright & Schulte LLC partner, Richard W. Schulte, has been appointed to the Plaintiffs’ Steering Committee in the federal litigation. All of the C8 lawsuits pending in the multidistrict litigation allege that DuPont had information in its possession as early as the 1980s that indicated exposure to C8-tainted drinking water could lead to various adverse health consequences in exposed workers. Plaintiffs further allege that DuPont has known for several decades that discharge of C8 into the Ohio River from the Washington Works contaminated water supplies, and that C8 pollution from the facility could be reduced substantially by use of a carbon absorption treatment system.
