Attorneys In Laundry Pod Poisoning Lawsuits Look To Annual National Poison Prevention Week To Strengthen Need For Package Change
As the annual Poison Prevention Week nears we are reminded of dangerous consumer products. One in particular has families filing lawsuits against laundry prod manufacturers after their children and loved ones were poisoned after exposure to the candy-like laundry pods. There are currently at least 14 laundry pods lawsuits awaiting litigation after infants and the elderly ingested liquid laundry pods.
With more than 1,000 reports received for just laundry pod poisoning the American Association of Poison Control Centers (AAPCC) is preparing to alert the public about the dangers of product poisonings during National Poison Prevention Week. Among the themes of the annual event slated for March 20-26 is “Children Act Fast…So Do Poisons.” The poisoning of children by small laundry detergent packets are the subject of lawsuits filed on behalf of children that allege detergent manufacturers failed to make the packaging child-proof and failed to warn about the poisoning risks associated with their products.
According to the AAPCC, children are naturally curious, but they also act fast and it only takes seconds for a child to get a hold of something dangerous. In 2014, just under half of the 2.9 million exposure cases managed by poison centers nationwide involved children under 6. Of those cases, pain relievers (analgesics), cosmetics/personal care products, and household cleaning products, such as liquid laundry pods, were the top three substance categories in which youngsters were involved. In 2015, the AAPCC received 12,594 reports of liquid laundry pod exposure, which is doubled the number of 6,343 reports received in 2012 when the monitoring began.

“Whether it’s poisoning from a laundry detergent pod or another toxic product, any time is a perfect time to raise awareness of poison dangers,” says Richard Schulte, a founding partner of Wright & Schulte LLC which is representing the families of 13 children in laundry pod lawsuits who were injured allegedly after being exposed to Procter & Gamble’s Tide Pods laundry detergent packets. (Case No. A14068580, Court of Common Pleas in Hamilton County, Ohio) The Firm is also representing the family of an elderly man in another laundry pod poisoning lawsuit involving a 67-year-old Ohio man with diminished capacity who died after swallowing a Tide Pod. (Case No. A 1500868, Hamilton County (Ohio) Court of Common Pleas)
The Wall Street Journal reported that at least seven children and adults have died allegedly after biting into colorful, pre-measured laundry pods which are designed to wash a single load of clothes. Children who bite into or swallow the detergent suffer burns, irritation, and drooling in the mouth, excessive vomiting, wheezing, gasping, sleepiness and have breathing problems serious enough to need a ventilator to help them breathe. In 2013, a 7-month-old Florida boy died after biting into an All Might Pacs pod which is made by Sun Products Corp.

In September, detergent manufacturers agreed to adopt a voluntary safety standard for the packaging of their products. Under the new standard, pods will be placed in opaque containers so children cannot see them, the containers will be harder to open, and a bitter taste will be added to the film that encases the pods as a deterrent to children putting the packets in their mouths.
