Xarelto Bleeding Lawsuits Contend The Anticoagulant Causes Blood Clots, Internal Bleeding, Gastrointestinal And Brain Hemorrhages That Can Lead To Death.
The federal judge managing the multidistrict litigation for Xarelto bleeding lawsuits confirmed that 40 cases have been selected for the bellwether discovery pool. The Xarelto lawsuits allege plaintiffs suffered blood clots, bleeding in the brain, gastrointestinal bleeding, and fatal bleeding after taking the blood thinner. The complaints also contend Bayer HealthCare AG and Johnson & Johnson’s Janssen Pharmaceuticals Inc. unit, Xarelto’s maker and marketer, did not adequately warn of the bleeding risks associated with the anticoagulant medication. Judge Eldon Fallon issued an order on March 7 listing the 40 Xarelto bleeding lawsuit claims that will go through the discovery process. The cases are representative of the 3,900 Xarelto complaints consolidated in the U.S. District Court, Eastern District of Louisiana for coordinated pretrial proceedings. Attorneys for plaintiffs and defendants filed a joint report to Judge Fallon on March 11 indicating that they were prepared to discuss the selected discovery pool cases during a case management conference on March 16. The parties were slated to discuss plaintiff and defendant fact sheets, preserving documents and electronically stored information, and other discovery issues, according to the joint report. Xarelto (rivaroxaban) is a blood thinner approved by the U.S. Food and Drug Administration (FDA) in July 2011 to reduce the risk of deep vein thrombosis and pulmonary embolism from occurring after hip or knee replacement surgery. Xarelto’s approval was expanded in November 2011 to reduce the risk of stroke in people with atrial fibrillation not caused by a heart valve problem. The blood thinner’s use was further expanded in November 2012 to treat deep vein thrombosis and pulmonary embolism.
Bayer’s blockbuster drug is popular because the blood thinner does not require patients to have their blood monitored on a regular basis as does warfarin, a rival blood thinner marketed under the brand names, Coumadin and Jantoven. The two blood thinners have another difference, according to the FDA. Warfarin, which was approved more than 60 years ago, uses vitamin K as a reversal agent should internal bleeding occur whereas the new generation drug, Xarelto, does not have an approved reversal agent to counteract its anticoagulation effects.

Court records indicate that Judge Fallon scheduled the first two Xarelto bellwether trials for February 6, 2017, and March 13, 2017, in the district court in New Orleans. The third trial is scheduled for April 24, 2017 in Mississippi and the fourth trial is set for May 30, 2017 in Texas, at federal district courts yet to be determined.
