Wright & Schulte LLC Awaits The First Bellwether Trial Of A Pradaxa Lawsuits As It Could Provide Insight To Jury Rulings In Other Cases Involving Pradaxa Bleeding Allegations.

According to the Order, jury selection is set to begin on September 8, 2014. Prior to that, the parties are to submit an agreed jury questionnaire to the Court by August 1, 2014. In the run-up to the Pradaxa lawsuit trial, the Order stipulates that plaintiffs must submit their final witness list to the court by July 2nd, while defendants must furnish their list no later than July 9th. Deposition of all witnesses not previously deposed is to be completed by July 31, 2014. Hearings on evidentiary issues, including exhibit objections and motions in limine and/or deposition designations, will be held on August 27, and/or August 28, 2014, per the determination of the parties and the Court.
Court records indicate that more than 2,400 Pradaxa lawsuits have been filed in the U.S. District Court, Southern District of Illinois on behalf of alleged victims of Pradaxa bleeding side effects. According to Wright & Schulte LLC, the outcome of the proceeding’s first bellwether trial, as well as subsequent trials, may provide clues as to how juries could rule in cases involving similar allegations.
According to court documents, Pradaxa is a blood-thinning medication that is indicated to prevent strokes in people with atrial fibrillation. Plaintiffs allege that the drug’s manufacturer concealed its dangerous side effects, and misleadingly positioned Pradaxa as an improvement over warfarin, a blood thinner that had been in use for decades. The lawsuits take particular issue with the fact that there is currently no antidote for Pradaxa bleeding, short of dialysis to remove the drug from a patients’ blood stream. By contrast, warfarin bleeding can be stopped with the administration of vitamin K.
In October 2013, the Institute for Safe Medicine Practices (ISMP) reported that of all of the prescription drugs monitored by the U.S. Food & Drug Administration (FDA), Pradaxa was named in the most adverse even reports in 2012. A majority of the 3,300 reports naming the blood thinner that year involved Pradaxa bleeding, including several hundred fatalities. The ISMP also noted that Pradaxa side effects proved fatal in 18% of the cases, while injuries linked to warfarin resulted in fatal outcomes just 6.5% of the time.
