Shape-Ups’ Design Causes Serious Knee Injury, Alleges Skechers Lawsuit

The complaint for this Skechers Lawsuit details that the plaintiff bought his Shape-Ups in March 2011 after seeing various ads alleging that wearing these toning shoes could provide wearers with a number of health benefits. Specifically, while claiming that Shape-Ups could improve the muscle tone in wearers’ legs, buttocks and abs, Skechers ads also alleged that regularly wearing Shape-Ups could help consumers improve their circulation and posture.

According to court documents, within three months of purchasing and regularly wearing Shape-Ups, however, the plaintiff was attempting to stand up from a seated position when he suddenly fell because the unstable rocker bottom of his Shape-Ups rolled forwards. The fall caused the plaintiff excruciating knee pain. After going to the emergency room and having an x-ray, the plaintiff was told that he had fractured the patella in his left knee and would need to undergo surgery to treat his severe injury.

Court documents further state, that although the plaintiff underwent knee surgery in June 2011, shortly thereafter, he fell again due to his weakened knee, causing the surgical site to reopen. Days later, the plaintiff underwent a second knee surgery to treat these painful complications. Despite undergoing two knee surgeries, the plaintiff still reportedly has constant pain in and limited use of his left knee.

$40M Class-Action Skechers Lawsuit Settlement

In addition to alleging that Shape-Ups’ defective design were responsible for the plaintiff’s serious injuries, this case also contends that Skechers claims about the alleged health benefits of Shape-Ups have not been validated by credible scientific research. In fact, an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf, June 2010]

Such allegations that Skechers’ has misrepresented Shape-Ups’ health benefits have been at the heart of thousands of lawsuits and have cost Skechers millions in settlements to consumers throughout the U.S. In fact, in May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on more than 500,000 consumer claims that Skechers intentionally misrepresented the safety and effectiveness of Shape-Ups in its advertising. In his ruling, the judge also ordered Skechers to stop running misleading ads for its toning shoes.
