While Advantages Of Robotic Surgery Remain Unproven, Questions Continue To Surround Purportedly Aggressive Marketing Tactics Used By Intuitive Surgical, Inc. To Promote Da Vinci Surgical System.
A new robotic surgery report from Bloomberg News contains disturbing details about the marketing tactics used by Intuitive Surgical, Inc. to promote sales of its Da Vinci Surgical System, according to the robotic surgery lawsuit attorneys at Wright & Schulte LLC. Among other things, the article details marketing materials used by Intuitive that purportedly make unproven claims about the benefits of robotic surgery. The tactics appear to be working, as use of the Da Vinci robot has grown 60% since 2010, Bloomberg said.
At the same time, Bloomberg found that reports of Da Vinci robotic surgery complications have also increased, with the device having been allegedly linked to 70 deaths in informal incident reports sent to the U.S. Food & Drug Administration (FDA) since 2009. During the first 8 months of this year, reports of Da Vinci injuries to the FDA have doubled, according to Bloomberg.
Disturbing Interviews About Robotic Surgery
Wright & Schulte LLC found Bloomberg’s interview with the executive medical director for perioperative services at Massachusetts General Hospital particularly disturbing. He discussed how Intuitive Surgical sales reps bombarded the hospital in an attempt to convince Massachusetts General to partner with the company, by either providing doctors with training on the device, conducting robot surgery symposiums or advertising the benefits of the Da Vinci. The sales reps’ advances were soundly rejected by the hospital, which only employs robotic surgery on a very limited basis, with the executive telling Bloomberg that Intuitive Surgical’s marketing “has pushed the limits of truth.”
In another interview, a 41-year-old California woman who suffered serious bowel injuries in a Da Vinci hysterectomy described how she was enticed to undergo robotic surgery after viewing a YouTube video and brochure that touted the supposed advantages of such procedures. “They are deceiving people,” she told Bloomberg. “People don’t hear the cons they only hear the pros.”
According to Wright & Schulte LLC, this woman’s experience echoes those of numerous individuals who have contacted the firm seeking information on filing a Da Vinci robotic surgery lawsuit. In July, Intuitive Surgical disclosed in a regulatory filing that it had been named in 33 Da Vinci surgery lawsuits filed on behalf of people who were seriously injured in robotic surgeries. These lawsuits also question the manner in which Intuitive Surgical has marketed the Da Vinci Surgical System.
Wright & Schulte LLC is now offering free legal evaluations to alleged victims of Da Vinci surgery complications, including tears and burns of the intestines, torn blood vessels, excessive bleeding, infections, punctured or cut ureters, damaged bowels, or vaginal cuff dehiscence.
