NuvaRing Lawsuit | Side Effects - Blood Clots, Clots, Deep Vein Thrombosis-2The federal judge overseeing hundreds of NuvaRing lawsuits in U.S. District Court, Eastern District of Missouri, has scheduled the litigation’s first bellwether trial for January 27, 2014. According to an Order dated July 30th, the proceeding’s first NuvaRing lawsuit trial was supposed to begin in October 2013, but U.S. District Judge Rodney Sippel postponed the start date, as well as current discovery, motions or other rulings. The Order further directed the parties to “maintain regular and frequent contact with the mediator” who has been appointed by the Court to oversee NuvaRing lawsuit settlement negotiations. NuvaRing is a once-a-month vaginal birth control ring which is marketed as being more convenient than birth control pills or the patch, yet equally efficient. However, a study commissioned by the U.S. Food & Drug Administration and published in 2011 found a 56% increased NuvaRing blood clot risk, including a higher danger of deep vein thrombosis and pulmonary embolism, compared to oral contraceptives. In the summer of 2012, research published in both The New England Journal of Medicine and the British Medical Journal indicated that NuvaRing side effects included a higher risk of dangerous blood clots, as well as heart attacks and strokes.

Court documents indicate that more than 1,370 NuvaRing side effect lawsuits are pending in the federal multidistrict litigation in Missouri. An additional 200 NuvaRing lawsuits have been filed in a consolidated litigation in Bergen County Superior Court, New Jersey. (In re: NuvaRing Litigation, BER-L-3081-09) All of the claims pending in both proceedings allege that NuvaRing releases higher amounts of hormones than other hormonal contraceptives, thereby increasing a user’s risk for serious blood clots that have the potential to cause heart attacks, stroke, and even death.

According to court records, the NuvaRing lawsuit selected for the federal litigation’s first bellwether trial was filed on behalf of a woman who was just 33-years-old when she suffered a pulmonary embolism, which her lawsuit blames on the contraceptive device. According to Wright & Schulte LLC, the case is extremely important, as it could gauge how juries might rule in similar lawsuits, and have a significant impact on NuvaRing settlement negotiations.
