C8, also known as PFOA or perfluorooctanoic acid, is a chemical that was used by DuPont in the manufacture of Teflon. In 2005, DuPont reached a settlement in a C8 class action lawsuit which, among other things, established the C8 Science Panel and charged it with investigating potential links between exposure to the chemical and a number of serious illnesses. In October 2012, the Panel reported that it had established a probable association between C8 exposure and kidney cancer, testicular cancer, thyroid disease, inflammatory bowel disease, preeclampsia, and high cholesterol. The C8 class action lawsuit settlement, which affected some 70,000 Ohio and West Virginia residents who lived and worked in the vicinity of the Washington Works plant, also stipulated that any individual who had been exposed to C8 contaminated water would be eligible to file a personal injury lawsuit if they developed a disease ultimately determined to be associated with C8 exposure. In order to file an individual C8 lawsuit against DuPont, potential plaintiffs must have been diagnosed with a related disease, and they must have lived in one of six water districts included in the settlement prior to December 1, 2004. Those six water districts are:

  • Little Hocking, Ohio
  • Belpre, Ohio
  • Village of Pomeroy, Ohio
  • Tuppers Plains, Ohio
  • Lubeck Public Service District, West Virginia
  • Mason County Public Service District, West Virginia

A federal multidistrict litigation was established this past April in the Southern District of Ohio to handle all personal injury and wrongful death claims filed in accordance with the terms of the 2005 C8 class action lawsuit settlement. According to court documents, U.S. District Judge Edmund Sargus, who is overseeing the federal C8 lawsuits, has scheduled the multidistrict litigation’s first bellwether trial for September 2015. A second C8 lawsuit will head to trial in November 2015.
