As coordinated pretrial proceedings begin for consolidated Zofran lawsuit claims, a Zofran complaint has been filed by an Alabama couple alleging their child had three “hole in the heart” birth defects due to the mother using Zofran during pregnancy. Zofran birth defects lawsuits allege that the anti-nausea drug was promoted for the off-label use of treating morning sickness in pregnant women. According to the Zofran birth defects lawsuit, the Alabama mother began taking Zofran in 2011 during her first trimester to treat pregnancy-related nausea. The baby was born “cyanotic,” having a bluish tint to the skin and lips due to a lack of oxygen in the blood. The newborn was hospitalized for two months and was diagnosed with three separate atrial septal defects, more commonly known as “holes in the heart.” In 2015, the now 4-year-old child underwent surgery to repair the largest hole, which measured 0.6 inches by 0.7 inches in size, according to the complaint. The couple accuses Zofran’s maker, GlaxoSmithKline, of improperly marketing the drug as a safe and effective treatment for morning sickness when it had not been approved for that use. Zofran (ondansetron) is approved by the U.S. Food and Drug Administration (FDA) to treat nausea and vomiting induced by chemotherapy, radiation and surgery. Zofran does not have FDA-approval to treat nausea and vomiting in expectant mothers, referred to as “morning sickness,” and Zofran has never been shown to be safe for pregnant women. As a result of complaints of GlaxoSmithKline’s off-label promotion of Zofran and its other drugs, civil and criminal claims were brought against the U.K.-based pharmaceutical company by the U.S. Department of Justice (DOJ). GlaxoSmithKline settled the case in 2012 by agreeing to pay $3 billion to resolve fraud allegations and other claims of illegally marketing several of its drugs, including Zofran, and paying kickbacks to doctors who prescribe the drugs. The DOJ said the case was the largest health care fraud settlement in U.S. history and the largest payment ever made by a drug company, and it remains so to date.

Court documents indicate that federal Zofran lawsuit claims were centralized in the U.S. District Court, District of Massachusetts in October. GlaxoSmithKline asked a federal judicial panel to consolidate the growing number of Zofran complaints against the company. There were 12 Zofran birth defects lawsuits transferred into the newly created multidistrict litigation in October, and at least 42 other Zofran complaints pending in various federal courts will likely be sent there as well, as could any cases filed in the future.
