The number of Zofran birth defects lawsuits grew from 270 to 284 from July 15 to August 15, according to the MDL docket of the U.S. Judicial Panel on Multidistrict Litigation (JPML). The judicial panel consolidated all federally filed Zofran birth defects complaints for coordinated pretrial proceedings in the U.S. District Court, District of Massachusetts. Recently, U.S. District Judge F. Dennis Saylor IV, who is managing the Zofran MDL, made it simpler for plaintiffs to file their lawsuits by using Short Form Complaints. Zofran (ondansetron) is an anti-nausea drug approved by the U.S. Food and Drug Administration (FDA) to treat nausea and vomiting associated with chemotherapy and radiation therapy, and after surgery. According to court records filed by GlaxoSmithKline, there is also a generic version of ondansetron that the FDA approved in 2006. Sales of ondansetron have increased and at least 30 companies now manufacture different forms of generic ondansetron, according to GlaxoSmithKline. The Zofran birth defects lawsuits maintain that the FDA did not approve Zofran to treat nausea and vomiting, commonly known as “morning sickness,” in pregnant women. To substantiate their claims, plaintiffs point to the criminal charges and civil claims brought by the U.S. Department of Justice (DOJ) against GlaxoSmithKline. In July 2012, GlaxoSmithKline agreed to pay $3 billion to resolve the claims that include paying kickbacks to doctors to prescribe Zofran and certain of the company’s other drugs, and submitting false claims to federal health care programs.

In another effort to streamline the Zofrant lawsuit filing process, Judge Saylor is allowing plaintiffs to file their complaints directly into the Zofran MDL rather than filing in their local federal court for transfer to Massachusetts. According to the Zofran MDL docket, one Short Form Complaint was recently filed into the MDL involving prenatal exposure to Zofran. The Zofran complaint, filed on behalf of a Texas couple, said the mother took Zofran during the first trimester of pregnancy which resulted in the premature birth and death of the child.
