Two cases selected allege gastrointestinal bleeding and bleeding in the brain, while the other two cases allege gastrointestinal bleeding and bleeding in the brain resulting in death after taking Xarelto anticoagulant medication. The bellwether cases mirror the 7,200 cases pending in the U.S. District Court for the Eastern District of Louisiana that allege Bayer HealthCare and Janssen Pharmaceuticals Inc., Xarelto’s maker and marketer, did not adequately warn of the bleeding risks associated with the blood thinner. In an order issued on August 16, Judge Eldon E. Fallon, who is managing the Xarelto lawsuit litigation, said the first two Xarelto cases will be tried in the federal court in New Orleans. The first Xarelto case, scheduled for trial in February 2017, involves a plaintiff who was prescribed Xarelto in January 2014 and began to suffer severe gastrointestinal bleeding less than a month later. The plaintiff was hospitalized and had several blood transfusions. (Case No. 2:14-cv-02720). The second Xarelto case, scheduled for March, involves a woman who died from a hemorrhagic stroke, or bleeding in the brain, and died 10 days later. (Case No. 2:15-cv-03708) Judge Fallon ordered the third Xarelto case held in Mississippi. This case involves a woman who was prescribed Xarelto to treat deep vein thrombosis and pulmonary embolism and suffered gastrointestinal bleeding. (Case No. 2:15-cv-03469) The fourth Xarelto case, to be tried in Texas, alleges the plaintiff took Xarelto to treat atrial fibrillation and suffered gastrointestinal bleeding and died. Xarelto (rivaroxaban) is Bayer’s blockbuster blood thinner approved by the U.S. Food and Drug Administration (FDA) to treat deep vein thrombosis, pulmonary embolism and atrial fibrillation not caused by a heart valve problem, and to reduce the risk of blood clots. Bayer claims Xarelto is the number one prescribed blood thinner in its class with more than 21 million Xarelto prescriptions in the United States. The FDA calls Xarelto a new-generation blood thinner compared to warfarin (Coumadin, Jantoven), which has been on the market since 1954. Bayer promotes Xarelto as more convenient for patients because routine blood monitoring is not required and there are no known diet restrictions, as there are for patients taking warfarin. However, Xarelto does not have an approved antidote should internal bleeding occur whereas warfarin uses vitamin K as a reversal agent to treat internal bleeding, according to the FDA.
