According to her lawsuit, the Plaintiff was walking on a flat surface in a parking lot on November 25, 2010. Suddenly and without warning, one of her Skechers Shape-Ups toning shoes rolled forward and caused her to fall, resulting in unconsciousness and then excruciating pain. Ultimately, the Plaintiff was diagnosed with a left orbital fracture. As a result of her injury, the complaint alleges she has incurred, among other thing, significant medical expenses, possibly future medical expenses, pain, mental anguish and lost wages. Additionally, she is at increased risk for future health problems and disability
The Plaintiff claims that after seeing many television and print advertisements touting the benefits of Skechers toning shoes, she was lulled into purchasing a dangerous product that the Defendant knew produced a substantial risk of causing chronic injuries and inducing falls. According to the Skechers Shape-Ups lawsuit, Skechers Shape-Ups’ rocker bottom soles are designed to create instability and to change gait mechanics, which can and does cause chronic injuries. The complaint further charges that the health risks of Skechers outweigh the absence of any benefit provided to the wearer.
