Skechers Shape-Ups Lawsuit Alleges Defendants Failed to Provide an Adequate Warning to Consumers Regarding Risk of Serious Bodily Harm Associated with Skechers Toning Shoes.

The lawsuit, which was filed in U.S. District Court, Western District of Kentucky, alleges Skechers U.S.A. and other Defendants failed to provide an adequate warning to consumers regarding the risk of serious bodily harm associated with Skechers Toning Shoes (Case No. 3:12-cv-00525-TBR).

According to her lawsuit, the Plaintiff purchased her Skechers Shape-Ups in April 2011, after relying on advertising that touted the many health benefits of Skechers toning shoes. On July 13, 2011, she was wearing her Shape-Ups while walking on a flat surface when without warning, one of the toning shoes pronated inward, resulting in the collapse of her right ankle, and causing the Plaintiff to fall in excruciating pain. An X-ray revealed she had broken her right ankle. Due to her fracture, the Plaintiff was forced to undergo physical therapy for approximately three months.

According to the complaint, Skechers Shape-Ups feature a pronounced rocker bottom sole that is intentionally designed to create instability and to change gait mechanics. The Defendants promote Skechers Shape-Ups as footwear that will provide countless health benefits including improved cardiac function and orthopedic benefits. However, the lawsuit alleges that it is well established in the medical literature that changing one’s gait can and does cause chronic injuries, including fractures. Yet the Defendants continue to market and promote Skechers Shape-Ups without performing any safety testing, despite a body of literature and numerous complaints about chronic and traumatic injuries, according to the complaint.
