Lawsuit Alleges that Although DuPont Marketed Imprelis as Environmentally Friendly and Safe to Use, Imprelis Actually Proved to be a Frighteningly Effective Tree Killer During its Short Time on the Market.
The nationwide law firm of Wright & Schulte LLC has filed a new Imprelis lawsuit on behalf of Ohio property owners who sustained significant damage and death to at least five trees, including mature White Pines and Scotch Pines, allegedly due to DuPont’s Imprelis herbicide. The lawsuit, which was filed in U.S. District Court, Western District of Ohio, alleges that despite DuPont’s assurances that Imprelis was environmentally friendly and safe to use, Imprelis actually proved to be a frighteningly effective tree killer during its short time on the market. According to the complaint, DuPont introduced Imprelis herbicide in October 2010 and marketed the product as a safe and effective way to treat the roots and shoots of the most common and hard to kill broadleaf weeds present in turf grass without any negative impact on surrounding plants. In fact, Imprelis is an aminocyclopyrachlor methyl herbicide, which the lawsuit asserts is four times more powerful than Agent Orange. By June 2011, the Environmental Protection Agency (EPA) was investigating reports of tree damage and death following applications of Imprelis. In August 2011, the agency issued DuPont a Stop Sale, Use, or Removal Order (SSURO), after Imprelis was found to have killed or damaged thousands of ornamental landscape trees, including Norway spruces, eastern white pines, conifer trees, willow trees, poplar trees, deodora cedars, and balsam fir trees.
According to the lawsuit, Imprelis was applied to the Plaintiffs lawn at their Worthington, Ohio, property one time, on June 2, 2011. The complaint alleges the Plaintiffs suffered significant damage and harm to their trees, and will suffer even further damage to their lawn and gardens because of Imprelis. On September 7, 2012, a certified arborist visited the property and discovered damage to trees including but not limited to browning, curling, twisting, and death on at least five trees, including mature White Pines and Scotch Pines. The lawsuit further alleges that the Plaintiffs have yet to discover the full extent of the damage caused by Imprelis, including but not limited to damage to trees, plants, shrubs and/or soil remediation.
The Plaintiffs being represented by Wright & Schulte LLC are just among thousands of property owners who have chosen to file Imprelis lawsuits against DuPont. In the year since DuPont was ordered by the EPA to remove Imprelis from the market, the company has established a claims process to reimburse customers for their dead and dying trees. However, according to a recent report from The New York Times, DuPont is requiring property owners to waive their right to sue if they accept compensation from this program. The same article reported that some homeowners have become frustrated with the pace of DuPont’s Imprelis claims process and communications from the company.
