Lawsuit Claims Plaintiff Suffered Elevated Cobalt and Chromium Levels and Required Revision Surgery Following Implantation of Two DePuy ASR Metal-on-Metal Hip Replacement Devices.

The nationwide law firm of Wright & Schulte LLC that represents victims of defective medical devices, has filed a DePuy Orthopaedics’ ASR Hip Replacement lawsuit on behalf of an Ohio man who suffered elevated chromium and cobalt levels and other complications, allegedly caused by DePuy Orthopaedics’ ASR Hip Replacement devices. The lawsuit, which names DePuy Orthopaedics and its parent, Johnson & Johnson, among the Defendants, was filed on July 19, 2012, in the DePuy Orthopaedics ASR Hip Implant Products Liability Litigation (MDL 2197) currently underway in U.S. District Court, Northern District of Ohio. DePuy Orthopaedics and Johnson & Johnson are named in roughly 4,200 lawsuits in the DePuy ASR hip implant litigation pending before U.S. District Judge David Katz in the Northern District of Ohio, and face an additional 2,000 claims filed in various state courts. The litigation was prompted by DePuy Orthopaedics’ August 2010 worldwide recall of its ASR hip replacement devices, and the company’s admission that more than 12 percent of the devices failed within five years. The first trials in the federal DePuy ASR hip implant litigation are expected to start sometime in the Spring of 2013.
According to the complaint filed by Wright & Schulte LLC, the Plaintiff, a 55-year-old man from Lancaster, Ohio, received a DePuy ASR metal-on-metal hip implant in his right hip on or about October 3, 2006. The Plaintiff was then implanted with an ASR hip replacement in his left hip on November 1, 2006. The lawsuit alleges that as a result of his hip implants, the Plaintiff suffered personal and economic injuries, including out of pocket expenses, multiple doctor visits, constant pain and suffering, elevated levels of cobalt and chromium, overall loss of his quality of life, revision surgeries, loss of income, and knee surgery. The Plaintiff ultimately had his left hip implant device explanted on January 1, 2011. The ASR hip implant placed in his right hip was explanted on June 6, 2011.
The DePuy ASR hip implant is a metal-on-metal hip replacement device, a class of hip implants that have been associated with a high rate of complications, including implant loosening, metal poisoning, inflammation, stiffness, impaired mobility, bone and tissue damage, the development of pseudotumors, and debilitating pain, all of which can necessitate the need for painful revision surgery to remove and replace the device. Last month, the U.S. Food & Drug Administration (FDA) revealed that there had been nearly 17,000 adverse event reports associated with metal-on-metal hip implants from 2000 to 2011. An FDA advisory panel has recommended that patients with metal-on-metal hip implants should be regularly monitored via imaging tests and blood screening to ensure that the devices are not failing or shedding dangerous levels of metal ions.
