Lawsuit Alleges DePuy ASR Metal-on-Metal Hip Implant Caused Serious Injuries, Including Elevated Levels of Cobalt and Chromium Ions, Stress Induced Cardiomyopathy and Congestive Health Failure.

The complaint, which was filed in U.S. District Court, Northern District of Ohio on August 16, 2012, joins thousands of similar claims currently pending in the DePuy Orthopaedics ASR Hip Implant Products Liability Litigation – MDL 2197. According to the complaint, the alleged victim received a DePuy ASR hip implant in her right hip on July 2, 2007. The device was explanted less than four years later, in January 2011. The lawsuit alleges that the Plaintiff suffered constant pain and suffering, elevated cobalt and chromium ions in her blood, stress induced cardiomyopathy and congestive heart failure, and an overall loss in the quality of her life, all as a result of a defect in the ASR hip implant. The complaint further alleges that the Plaintiff’s injuries caused her to sustain economic damages, including medical bills and out-of-pocket expenses.

The DePuy ASR hip implant, a metal-on-metal device, was recalled by DePuy Orthopaedics, a division of Johnson & Johnson, in August 2010, after data indicated that more than 12 percent of the devices failed within five years of implantation. At the time of the recall, more than 93,000 DePuy ASR hip replacement devices had been sold worldwide, including 37,000 in the U.S. Since the recall, new research has indicated that the premature failure rate for the ASR hip implants could be far higher than first thought – perhaps as high as 49% at six years post-implantation.

In the two years that have passed since DePuy Orthopaedics pulled its ASR hip implant products off the market, additional research has cast doubt on the safety of the entire class of metal-on-metal hip replacement devices. In May 2011 the U.S. Food & Drug Administration (FDA) ordered five producers of metal-on-metal hips to undertake studies to assess the safety of metal-on-metal hip implants. In June, an FDA advisory panel recommended that patients with metal-on-metal hip implants should be regularly monitored via imaging tests and blood screening to ensure that the devices are not failing or shedding dangerous levels of metal ions. Most panelists agreed that there were few, if any, cases where they would recommend the use of metal-on-metal hip implants.

Earlier this year, the U.K. Medicines and Healthcare Products Regulatory Agency (MHPRA) recommended that all patients who have receive metal-on-metal hip implants to undergo annual blood tests to make to screen or elevated levels of metal ions in their blood. In May, Health Canada issued its own warning regarding complications associated with metal-on-metal hip implants.

So far, more than 4,000 recipients of the DePuy ASR hip implant have filed suit in the multidistrict litigation now underway in the Northern District of Ohio. Last month, the Honorable Judge David A. Katz announced that the first bellwether trial in the Ohio litigation will begin on May 6, 2013, and the second will follow on July, 8, 2013.
