HR 985, The Fairness in Class Action Litigation Act of 2017, Would Obliterate Rights of Injured Consumers Seeking Justice Against Large Corporations

HR-985-Limiting-Class-Action-LawsuitsLast Thursday, the U.S. House of Representatives passed HR 985, the so-called Fairness in Class Action Litigation Act of 2017, which would greatly curb consumers’ rights to pursue class action lawsuits and mass tort claims against large, wealthy corporations that have caused them harm. Not a single Democrat voted for the bill, while the Republican members of the House Liberty Caucus also opposed it on the grounds that it would aid “bad actors” by making it more difficult to seek redress via the courts. The bill will now head to the U.S. Senate for consideration.

H.R. 985 was rushed through the U.S. House without a hearing and without input from legal experts or the very people it would harm. If it becomes law, the bill would require federal courts to deny certification of class action lawsuits unless every one of the proposed class members was affirmatively demonstrated to have “suffered the same type and scope of injury” as the class representatives. The bill also ties attorney fees to settlement amounts and limits the types of clients lawyers could represent.
