The lead plaintiff in the Canadian class action was implanted in January 2010 with Boston Scientific’s synthetic Lynx mesh sling to treat stress urinary incontinence, the complaint said. After the implant, the plaintiff said she began experiencing pelvic pain, vaginal pain, pain in her buttocks and legs, urinary problems, lower abdominal pain, lower back ache, difficult bowel movements, difficulty walking, difficulty sleeping, difficulty crossing her legs, pain during sexual intercourse, and emotional stress, according to the complaint. Boston Scientific opposed the certification, but Ontario Superior Court Justice Paul Perell granted the request in February. Transvaginal mesh are used to repair pelvic organs that drop from their normal position, and bladder mesh slings treat stress urinary incontinence in women. Surgical mesh came under scrutiny of the U.S. Food and Drug Administration (FDA) after the agency received over 3,800 adverse events reports about the device from 2008 to 2010. January 2016, the FDA reclassified transvaginal mesh from a class II device, which generally includes moderate-risk devices, to class III, which generally includes high-risk devices.

In May 2016, Boston Scientific added new safety warnings and precautions to its Advantage, Lynx, Obtryx, Obtryx II and Solyx transvaginal slings, and its Uphold LITE, Pinnacle LITE, and Upsylon Y mesh that treat pelvic organ prolapse in women. The company sent an Urgent Medical Device Product Advisory to notify medical professionals worldwide that complete removal of mesh cannot be possible and “additional surgeries may not always fully correct the complications.” The advisory also cautioned that the use of polypropylene mesh has been associated with erosion.

U.S. court documents indicate Boston Scientific is facing 15,550 vaginal mesh lawsuits pending in a multidistrict litigation in the U.S. District Court, District of Southern West Virginia. In 2014, the company was involved in two state court trials. In September 2014, a Dallas County, Texas jury ordered the company to pay $73 million to a woman who suffered permanent injuries from the Obtryx bladder mesh sling.The award was reduced to $35 million.
