Xarelto Bleeding Lawsuits Allege Bayer Failed To Warn That Xarelto Does Not Have An Antidote For Adverse Bleeding Events.

The multidisitrict litigation (MDL) pending in the U.S. District Court, Eastern District of Louisiana involves over 15,000 lawsuits that allege the Xarelto blood thinner causes brain bleeds, gastrointestinal bleeds, blood clots, and other uncontrollable bleeding risks, as well as death. U.S. District Judge Eldon Fallon, who is managing the Xarelto MDL, issued a Case Management Order (CMO) on December 20 which sets a briefing schedule for the first two bellwether trials. The CMO provides deadlines for parties to file and reply to specific motions regarding depositions from experts planning to testify during the trials. The CMO also covers deadlines for filing motions that seek to dismiss certain claims. Judge Fallon scheduled oral arguments on February 10 for motions to dismiss and for motions on experts whose depositions were completed by December 15. Judge Fallon set a March 8 hearing for motions on experts who concluded their depositions after December 15. The first Xarelto trial is scheduled for March 13 and the second is set for April 24. Xarelto (rivaroxaban) is a prescription blood thinner approved by the U.S. Food and Drug Administration (FDA) to treat deep vein thrombosis, pulmonary embolism and atrial fibrillation not caused by a heart valve problem. Manufactured and marketed by Bayer and Janssen Pharmaceuticals, Xarelto is a new generation blood thinner that has some advantages over warfarin, the only drug approved by the FDA since1954 for the prevention of stroke in patients with atrial fibrillation. According to the FDA, Xarelto has fewer interactions with food and other drugs and patients taking Xarelto do not need to have periodic blood test monitoring like patients taking warfarin. However, warfarin uses vitamin K as a reversal agent should significant bleeding occur in a patient. Xarelto does not have an antidote for adverse bleeding episodes, the FDA says. Court documents show that Xarelto complaints pending in the MDL contend that Bayer and Janssen Pharmaceuticals Inc., misrepresented Xarelto as safe and failed to adequately warn that Xarelto does not have an antidote to reverse its anticoagulant effects. Court records also show that the first Xarelto trial involves a Louisiana man who was prescribed Xarelto in January 2014 due to atrial fibrillation and suffered severe gastrointestinal bleeding less than a month later. The second Xarelto case involves a woman who took Xarelto for about a month for atrial fibrillation and died from bleeding in the brain.
