According to court documents, the transvaginal mesh lawsuit selected for the first federal C.R. Bard bellwether trial was filed on behalf of a woman who received an implant from the company’s Avaulta line of pelvic mesh devices. According to a report published on July 26, 2013, her lawsuit claims the company used a resin-based plastic in those implants that wasn’t fit for use in humans. In June, the judge overseeing the C.R. Bard litigation ruled that the Plaintiff could present as evidence internal company e-mails regarding the resin-based mesh that raised “a genuine issue of material fact about whether Bard was aware its conduct was practically certain to cause injuries.”

In an October 2008 Public Heath Notification, the U.S. Food & Drug Administration (FDA) advised it had received more than 1,000 complaints over a three year period relating to transvaginal mesh products. In a second Public Health Notification issued in July 2011, the FDA reported that it had received a total of 2,864 additional reports of vaginal mesh complications. The agency concluded that serious transvaginal mesh injuries in pelvic organ prolapse repair, were “not rare,” and further advised that this procedure “does not improve symptomatic results or quality of life over traditional non mesh repair.”
