The Tide Laundry Pod Lawsuit Claims Procter & Gamble Failed to Properly Package, Formulate and Disclose the Risks Associated with Tide Pods Laundry Detergent Product
Wright & Schulte LLC announce that they have filed a Tide Pods lawsuit following the death of an elderly man due to his alleged exposure to the contents of Procter & Gamble’s Tide Pods laundry detergent product. The complaint, which was filed on February 15, 2014 in Ohio’s Hamilton County Court of Common Pleas, alleges that Procter & Gamble’s failure to properly package, formulate and disclosed the risks associated with the Tide Pods product caused the Decedent to sustain serious injuries, and ultimately resulted in his death.
According to the complaint, Tide Pods are single use laundry packets designed to be used in domestic washing machines for the washing of clothes. Procter & Gamble introduced Tide Pods with great fanfare in February 2012, promising that the new product would transform the laundry lives of consumers across North America. However, in order to accomplish the single use goal with the relatively small amount of detergent contained in the packet, the lawsuit asserts that Tide Pods contains concentrated ingredients compared to the average liquid detergent. The filing also alleges that Tide Pods are bright and colorful, and can be said to resemble candy in many respects. Finally, the complaint claims that Tide Pods are sold in soft or hard plastic containers, and are not child or tamper proof in any way.
The complaint alleges that since 2012, single-load laundry packets such as Tide Pods have been implicated more than 17,000 instances of children under the age of 6 eating, inhaling or squirting the concentrated liquid ingredients into their eyes. At least one death has also been attributed to the ingestion of a single-use laundry pod. In September 2012, New York Senator Charles Schumer called upon manufacturers to create childproof packaging to prevent further injuries. However, the lawsuit claims that Procter & Gamble have failed to make the packaging of the Tide Pods product child proof and have failed to reformulate the packets to make them less attractive and less poisonous to children.

According to the Tide Pod lawsuit, the Decedent suffered from diminished capacity prior to his death, and therefore the same issues raised in the complaint concerning a child’s interaction with Tide Pods applies equally to Decedent as well as other individuals with diminished mental capacity. On or about February 15, 2014, he swallowed, inhaled or was exposed to the contents of a Tide Pods packet. This allegedly resulted in serious personal injuries, including his tragic death. The lawsuit asserts that had the Defendants properly packaged, formulated and disclosed the risks associated with Tide Pods, the Decedent would not have suffered the aforesaid injuries and would not have tragically died.
The Tide Pods lawsuit seeks compensation for, among other things, negligence, failure to warn, defective design, loss of consortium, and wrongful death. The Complaint also asks the Court to assess punitive damages, attorney’s fees, and any other and further relief deemed just and proper.
