Bellwether trials are seen as test trials that give plaintiffs, defendants, and the court an idea of the outcome of future trials. Judge Young, who is managing the multidistrict litigation (MDL), has scheduled the first trial for after February 2017. The first case selected for trial involves a Florida woman who had a Cook Celect IVC filter implanted in November 2010. Doctors tried unsuccessfully to remove the device in March 2011. Over the next three years, the plaintiff experienced severe gastrointestinal symptoms, fatigue, diarrhea, vomiting and abdominal pain, the complaint said. A colonoscopy revealed that the IVC filter had perorated her inferior vena cava and migrated into her duodenom. IVC filters are small, cage-like devices inserted into the inferior vena cava to capture blood clots. The inferior vena cava is a major vessel that returns blood from the lower half of the body to the heart. The IVC filters’ struts or “legs” stop blood clots from reaching the lungs. Blood clots that are not stopped from traveling to the lungs can cause a pulmonary embolism, which can be fatal.
The U.S. Food and Drug Administration (FDA) issued a safety alert about the device due to receiving 921 adverse event reports regarding IVC filters since 2005. The complaints reported included the entire IVC filters moving from their original position, filter fragments moving to the heart or lungs, filters perforating the inferior vena cava, and filters being difficult to remove. The FDA said some complications may be avoided if the filter is removed between 29 and 54 days after it’s implanted.
Court documents indicate that IVC filter lawsuit claims against Cook Medical were centralized for pretrial proceedings in the U.S. District Court, Southern District of Indiana in October 2014. The cases selected for bellwether trials are representative of the hundreds of cases pending in the MDL. The lawsuits allege Cook Medical’s IVC filters have design defects that cause the devices to migrate, fracture, tilt or perforate organs.
