Transvaginal Mesh Lawsuit Trial Was First in the U.S. Involving Ethicon Inc.’s TVT-O Mesh Sling, A Pelvic Mesh Device Used to Treat Stress Urinary Incontinence

Court records indicate that the trial, which ended on April 3rd in the District Court for the 95th Judicial District, Dallas County, was the first in the nation to involve TVT-O Mesh, which is used to treat stress urinary incontinence. According to court documents, the vaginal mesh lawsuit had been filed on behalf of a 64-year-old woman who claimed that erosion of the mesh inside her body had caused chronic pelvic pain. In awarding the plaintiff $1.2 million, the jury agreed that the TVT-O Mesh device was defectively designed. However, the jurors declined to award punitive damages, after rejecting her allegation that Ethicon hadn’t provided adequate warnings about the risks associated with the mesh.

Court filings indicate that Ethicon, a unit of Johnson & Johnson, is facing more than 22,000 transvaginal mesh lawsuit filed on behalf of women who were allegedly injured by the company’s pelvic mesh products. More than 17,000 claims are pending in a federal multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. Nearly 5,000 more have been consolidated in Atlantic County Superior Court in New Jersey. According to court documents, the country’s first trial against Ethicon ended in March 2013, when an Atlantic County Superior Court jury found in favor of a woman who received the Gynecare Prolift device, and awarded her more than $11 million in compensatory and punitive damages. According to court documents, more than 50,000 transvaginal lawsuits are now pending in the Southern District of West Virginia. The Ethicon litigation is just one of several established in that jurisdiction to handle the claims. Others include:

The U.S. Food & Drug Administration (FDA) issued warnings in October 2008 and July 2011 regarding the risk of serious vaginal mesh complications associated with transvaginal mesh products used to treat pelvic organ prolapse and stress urinary incontinence. According to the agency, the most frequently reported transvaginal mesh injuries include mesh erosion and shrinkage, chronic pain, infection, and pain during sexual intercourse.
