Heater-cooler systems keep patients warm or cool during cardiothoracic and other surgeries. According to the U.S. Food and Drug Administration (FDA), the heater-cooler units have water tanks that provide temperature-controlled water to external heat exchangers or to warming-cooling blankets through closed circuits. Patients do not come into direct contact with water in the device. However, contaminated water can potentially enter other parts of the device or transmit airborne bacteria through the unit’s exhaust vent into the environment and to the patient, the FDA says. CNN reported in October that the U.S. Centers for Disease Control confirmed infections in 28 U.S. heart surgery patients, and at least 12 people worldwide have died from the infections.

lawsuit was recently filed against LivaNova PLC on behalf of an Illinois man who developed an NTM infection caused by M. Chimaera. In February 2016, the plaintiff received a letter from the hospital saying he had been exposed to NTM bacteria via the hospital’s heater-cooler devices used during four separate heart surgeries in 2011 and 2012. The heater-cooler complaint says the plaintiff suffered a series of health complications and his health is rapidly deteriorating due to the NTM infection.
