Skechers Shape-Ups Lawsuit Filed by Wright & Schulte LLC on Behalf of Illinois Woman who Suffered a Foot Stress Fracture, Allegedly Due to Use of Skechers Toning Shoes


The Skechers Toning Shoe Lawsuit Alleges the Health Risks of Skechers Shape-Ups Outweigh the Absence of Any Benefit Provided to the Wearer.

The Skechers Shape-Ups lawsuit, which was filed on August 8, 2012, names Skechers USA Inc., Skechers USA Inc., II, and Skechers Fitness Group as Defendants (Case 3:12-cv-00478-TBR). The complaint is just one of dozens of Skechers Shape-Ups injury lawsuits pending in the Skechers Toning Shoe Product Liability Litigation (MDL 2308) now underway in U.S. District Court, Western District of Kentucky. According to the complaint, Skechers Shape-Ups feature a pronounced rocker bottom sole that is intentionally designed to create instability and to change gait mechanics. The Defendants promote Skechers Shape-Ups as footwear that will provide countless health benefits including improved cardiac function and orthopedic benefits. However, the Skechers Shape-Ups lawsuit alleges that it is well established in the medical literature that changing one’s gait can and does cause chronic injuries, including stress fractures. The complaint further alleges that the health risks of Skechers outweigh the absence of any benefit provided to the wearer. Despite a body of literature and numerous complaints about chronic and traumatic injuries, the Defendants allegedly continue to market and promote Skechers Shape-Ups without performing any safety testing, the complaint states.

According to her lawsuit, the Plaintiff purchased a pair of Skechers Shape-Ups toning shoes in or about June 2009, after she had viewed many television and print advertisements touting the benefits of the shoes. On August 9, 2010, the Plaintiff was walking on a flat surface when she suddenly she felt a pop on the top of her left foot. After enduring pain in her foot for months, the Plaintiff underwent an MRI and X-rays in November 2010 that demonstrated a stress fracture in her left foot. She was required to wear an orthopedic boot to allow her stress fracture to heal. The Plaintiff claims that she has incurred significant medical expenses, could incur future medical expenses, and has suffered physical pain and mental anguish. The complaint further alleges she is now at increased risk for future health problems and disability.
