Skechers Lawsuit Filed By Wright & Schulte LLC on Behalf of Tennessee Man Alleges His Serious Foot Injuries Were Caused by the Unstable Design of Skechers Shape-Ups


Wright & Schulte has filed another Skechers lawsuit on behalf of a man from Tennessee who suffered a fracture to his left foot alleged due to the inherently unstable, defective design of Shape-Ups toning shoes.

This Skechers lawsuit (case no. 3:13-cv-00442-TBR) was filed on April 29, 2013 and is part of MDL 2308. As with other Skechers injury lawsuits recently filed by Wright & Schulte, this Skechers Shape-Ups lawsuit will be heard in the U.S. District Court of the Western District of Kentucky, Louisville Division.

Foot Fracture Caused by Toning Shoes’ Defective Design, Alleges Skechers Lawsuit
According to the complaint, the plaintiff bought his Shape-Ups in February 2011 after seeing various ads that acclaimed the alleged health benefits of these shoes. While Skechers ads claimed that wearers of Shape-Ups could improve the muscle tone of their legs, buttocks and abs, they also contended that wearing these shoes could help consumers get in shape without having to go to the gym.

Skechers Lawsuit

The Skechers Lawsuit further states; after about one year of wearing his Shape-Ups on a daily basis, the plaintiff fell when the unstable rocker bottom of one of his Shape-Ups rolled inwards, painfully twisting his left ankle. To treat his excruciating ankle pain, the plaintiff sought emergency medical care and was informed, following x-rays, that he had sustained a fracture to the navicular bone of this left foot (a bone where the top of the foot meets the ankle). This serious alleged Skechers injury required the plaintiff to wear a brace for three months and, subsequently, to undergo physical therapy to try to regain the strength and mobility in foot and ankle.

Court documents for this case also contend that “the health risks of Skechers outweigh the absence of any benefit provided to [individuals who wear Shape-Ups]” and that the defective rocker-bottom design of Skechers Shape-Ups was directly responsible for causing the plaintiff’s injuries.

Skechers Class-Action Skechers Settled for $40 Million

Despite Skechers ads claiming that Shape-Ups provide various health benefits to those wearing these shoes, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ June 2010]

In fact, Skechers misrepresentation of Shape-Ups health benefits has been the basis of thousands of product liability lawsuits filed against the company and has cost Skechers millions in settlement awards to consumers. In May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally mislead consumers in its Shape-Ups advertising. As part of this ruling, the court also found that Skechers is no longer allowed to run ads for its toning shoes.
