Plaintiff Alleges In Skechers Lawsuit That Skechers Shape-Ups are Defective Due to a Rocker Bottom Sole that Alters a Wearer’s Gait and Causes Severe Lateral Instability

An Oklahoma woman is the latest consumer to file a Skechers lawsuit after she suffered a severe broken ankle while merely walking in her home. The Plaintiff, who is being represented by the experienced product liability law firm of Wright & Schulte LLC, alleges that Skechers Shape-Ups are defective due to their rocker bottom sole, which altered the Plaintiff’s gait and caused severe lateral instability. The complaint is one of dozens of Skechers Shape-Ups injury lawsuits pending in a consolidated litigation underway in U.S. District Court, Western District of Kentucky. According to her Skechers injury lawsuit, the Plaintiff purchased her Skechers Shape-Ups in January 2011, after viewing many television and print advertisements touting the benefits of toning shoes. That advertising, which featured celebrity endorsers like Kim Kardashian and Super Bowl quarterback Joe Montana, promised the Skechers Shape-Ups would enable the wearer to “Shape Up While You Walk,” and “Get in Shape without Setting Foot in a Gym.” After initially wearing the shoes for 25-45 minute period for two weeks, the Plaintiff began wearing Skechers Shape-Ups during her daily activities.

According to court documents, on May 31, 2011, she was wearing the shoes while merely walking on a flat surface in her home. Suddenly and without warning, her Skechers Shape-Ups pronated inward and caused her ankle to collapse, leading her to fall in excruciating pain. The Plaintiff was ultimately diagnosed with a broken ankle, and forced to undergo surgery due to its severity. According to the Skechers injury lawsuit, the injury has forced the Plaintiff to endure a prolonged recovery period, constant pain and severe restrictions on her daily life.

Skechers Shape-Ups were brought to market in 2009. In 2010, a study conducted by the American Council on Exercise (ACE) raised serious questions about the efficacy and safety of toning shoes like Skechers Shape-Ups. By 2011, Consumer Reports had revealed that Skechers Shape-Ups and similar shoes had been the subject of more injury complaints than any other product in its database.

In May 2012, the manufacturer of Skechers Shape-Ups agreed to pay $40 million to settle charges with the Federal Trade Commission (FTC) that it had made unfounded claims that Shape-Ups would help people lose weight, and strengthen and tone their buttocks, legs and abdominal muscles. While the settlement provided consumers with refunds for the purchase of their shoes, it did not include compensation for injuries allegedly caused by Skechers Shape-Ups.
