Skechers Lawsuit Claim Contends an Alabama Woman Suffered Severe Knee Injuries After Wearing The Purportedly Unstable Shape-Ups toning shoes.

Skechers-Lawsuit-Lawyer-Wright-&-Schulte-LLC-3Another Skechers lawsuit claim filed by Wright & Schulte LLC on behalf of a woman from Alabama is currently seeking to hold the Skechers Corporation liable for the serious knee injuries the plaintiff reportedly sustained due to wearing Shape-Ups toning shoes. This Skechers claim (Case No. 3:13-cv-01245-TBR) is part of MDL 2308 and was filed on December 30, 2013 in the U.S. District Court of the Western District of Kentucky, Louisville Division.

According to court papers in this Skechers lawsuit claim, the plaintiff purchased her Shape-Ups in February 2011 and began feeling excruciating knee pain within a year of regularly wearing these toning shoes. After repeatedly falling while wearing these shoes (as the unstable rocker bottoms would reportedly cause her foot to turn inwards, buckling her knees), the plaintiff sought medical care for a proper diagnosis of her persisting knee pain. After receiving an MRI, the plaintiff was officially diagnosed with a torn meniscus.

Court documents further explain, the plaintiff initially pursued a conservative course of treatment, opting to wear a knee brace and undergo physical therapy in an effort to treat her knee injuries. However, when such conservative treatments failed, the plaintiff was reportedly forced to undergo intensive knee surgery in May 2012. According to the complaint, she is allegedly still suffering from knee pain and impaired knee function as a result of her Skechers injuries.

Additional Allegations in This Skechers Lawsuit Claim

This Skechers lawsuit has clearly alleged that the unstable rocker bottom design of Shape-Ups is dangerous and that this defective design was directly responsible for causing the plaintiff’s severe knee injuries. Additionally, this case has contended that Skechers failed to sufficiently test the safety of its toning shoes and that company intentionally misrepresented Shape-Ups’ safety and efficacy in the various ads for these shoes.

Research and Prior Verdict Backs Up Skechers Injury Allegations

Backing up the various allegations in Skechers lawsuit, the complaint cites an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin. While this and other Skechers lawsuits continue to progress, Skechers has already had to pay out 40 millions in settlements based on claims that it overstated the health bennfits of Shape-Ups. In fact, in May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally misrepresented the health benefits of Shape-Ups in its ads.
