Skechers Lawsuit Claim Alleges Multiple Ankle and Leg Fractures Due to Wearing Skechers Shape-Ups, Filed By Wright & Schulte LLC


A Georgia woman is the plaintiff in a Skechers lawsuit claim, filed by Wright & Schulte, alleges she broke multiple bones in her left ankle and leg due to the design of Skechers Shape-Ups

This case (Case No. 3:13-cv-00578-TBR) is part of MDL 2308 in the U.S. District Court of the Western District of Kentucky, Louisville Division. Court documents for this Skechers injury lawsuit argue that the purportedly dangerous design of Shape-Ups was responsible for causing the plaintiff to fall and break multiple bones in her left ankle and leg. This case also alleges that Skechers has misrepresented Shape-Ups as being safe and providing health benefits to wearers without any scientific proof to back up these claims.

According to the complaint for this case (Case No. 3:13-cv-00578-TBR), the plaintiff bought Shape-Ups in June 2011 after seeing a number of ads that claimed that wearing these toning shoes could improve her health. Specifically, Skechers ads stated that wearing Shape-Ups could help wearers get in shape, improve their overall muscle tone and improve both their circulation and posture.

Within one month of regularly wearing Shape-Ups, in July 2011, the plaintiff was walking on a flat surface when the unstable rocker bottom of one of her shoes caused her left ankle to buckle and her to fall. The fall resulted in immediate, severe ankle and leg pain, which led the plaintiff to seek emergency medical care. After having a CT scan, the plaintiff was told that she had broken several bones in her left ankle and leg and that she would need to undergo multiple surgeries to repair these fractures. Despite these surgeries and extensive physical therapy, however, the plaintiff still reportedly has limited use of and constant pain in her injured left ankle and leg.

Skechers Pays $40 Million Shape-Ups Settlement

This Skechers lawsuit alleges that Skechers has largely misrepresented the safety of Shape-Ups and that Skechers’ claims about Shape-Ups’ health benefits have not been validated by reliable scientific research. Backing up this allegation, the complaint cites an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin, which found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [ ] [June 2010]

Skechers questionable claims about Shape-Ups’ health benefits have sparked numerous lawsuits against the company and have cost Skechers millions. In fact, in May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally misrepresented the health benefits of Shape-Ups in its ads. As part of this ruling, the court also found that Skechers is no longer allowed to run ads for its toning shoes.
