This DePuy ASR hip replacement injury lawsuit was brought by a 54-year-old Illinois nurse who claims that her DePuy ASR hip replacement device allegedly failed after only three years, causing her to undergo revision surgery. In the lawsuit, the plaintiff also alleges that DePuy failed to warn consumers and physicians about the risks of the metal-on-metal DePuy ASR hip replacement device. According to Bloomberg, the plaintiff alleges that DePuy knew the design of the DePuy ASR replacement hip was defective and could cause the device to shed metal particles into the patient’s body, causing necrosis and high levels of metal ions in the blood. DePuy argued that the plaintiff had “an extremely lengthy and significant medical history,” that included autoimmune problems, and claimed that it was not known why some people have a negative reaction to devices. DePuy claims that the plaintiff’s “individual biology and health issues were the cause of the revision, not the device,” Bloomberg writes. The Illinois trial continues into its second week.

First DePuy ASR Hip Implant Trial

In the first DePuy ASR hip replacement injury trial, plaintiff Loren Kransky alleged that J&J executives were aware of a critical design flaw in the DePuy ASR hip replacement device years before they issued a massive recall. Kransky alleged that J&J concealed information regarding the flaw from consumers and their physicians, including that they knew it could shed large quantities of metal debris into the body and that it failed internal tests in 2007, the New York Times reports. In that case, the jury found the DePuy ASR hip is defective, but that DePuy did not act with malice or fraud. The jury awarded the plaintiff $338,000 in medical costs and $8 million in damages for pain and suffering. DePuy ASR Recall

DePuy recalled the ASR hip replacement devices in 2010, after selling more than 93,000 of them worldwide. At the time, the recall was initiated due to early failure rates. The company issued a statement claiming the DePuy ASR XL was properly designed and that DePuy’s actions regarding the product and the recall were “appropriate and responsible.” Since that time, nearly 11,000 DePuy ASR XL replacement hip lawsuits have been filed in courts across the country against DePuy alleging early failure rates, tissue necrosis, metallosis, and revision surgery.
