The case represents the types of injuries and retrieval challenges at issue in the multidistrict litigation (MDL), says U.S. District Judge Richard L. Young, who is presiding over the MDL. More than 900 IVC filter lawsuits are pending in the Southern District of Illinois that allege Cook Medical’s Celect and Günther Tulip Inferior Vena Cava (IVC) filters fail to trap blood clots, and are prone to tilt, fracture and move out of their original position and puncture the heart and lungs. According to Judge Young’s October 17th order, the second case involves a plaintiff who alleges a Günther Tulip filter perforated his inferior vena cava and cannot be removed due to the increased risk of death during the surgery. The plaintiff started suffering chest pain and shortness of breath after receiving the IVC implant in April 2011. The first lawsuit Judge Young chose in July involved a Florida woman whose Celect IVC filter had perforated her inferior vena cava and migrated into her duodenum. Plaintiffs disagreed with Judge Young’s lawsuit selections because the cases were selected from the discovery pool by Cook Medical. IVC filters are small, cage-like devices implanted into a large vein, called the inferior vena cava, to trap blood clots and prevent them from traveling to the lungs and causing a pulmonary embolism, which can be fatal. According to the U.S. Food and Drug Administration (FDA), IVC usage has increased over the past 30 years. However, the agency says its has received 921 complaints regarding IVC filters since 2005. The majority of the complaints involve IVC filters migrating from their original position. There are also complaints of the IVC filters perforating the inferior vena cava, and filter fracture. The FDA advises removing the IVC filters between 29 and 54 days after implant to avoid these complications from occurring.

Court documents indicate Judge Young scheduled the first bellwether trial for after February 2017, but the second case has not yet been scheduled. Bellwether trials are considered as test cases that give plaintiffs, defendants, and the court an idea of the outcome of future trials.
