According to the recently filed complaint, the plaintiff received the Wright Medical Profemur Total Hip System in March 2008 in her left hip. The Profemur system included the Conserve Plus Cup, Conserve Total A-Class Femoral Head, Wright Modular Femoral Neck and Profemur Z Femoral Stem. The hip replacement lawsuit states the Profemur system suddenly and catastrophically failed when the femoral neck fractured and broke into two pieces. The injuries from the fractured component caused the plaintiff to undergo surgery to have the Profemur hip replacement removed. The complaint contends the Profemur Total Hip System devices were defectively designed, and Wright Medical knew or should have known about the serious health risks the devices created. The Wright Profemur Total Hip System received 510(k) premarket approval by the U.S. Food and Drug Administration in 2001. Under this process, the FDA does not require medical device manufacturers to conduct clinical testing of their devices on humans if they can show that their device is substantially equivalent to a similar device already being sold on the U.S. market. The Profemur modular neck systems, including the Profemur Z, is flexible enough to allow surgeons to adjust the device during surgery to provide a better fit for patients, Wright Medical said in its 2016 annual report. However, hip replacement lawsuits allege the bending of the neck increases its potential for failure.

In addition to facing lawsuits over its Profemur Total Hip System, Wright Medical is in litigation over its metal-on-metal Conserve hip replacement system. In November, Wright Medical Technology announced an agreement to pay $240 million to settle 1,292 Conserve lawsuits nationwide. The complaints are filed on behalf of hip implant recipients who assert they have elevated chromium and cobalt levels in their blood due to metal debris from the hip implants, debilitating pain, permanent bone and tissue damage and other injuries. The Conserve complaints also allege the defective design of Wright Medical’s Conserve product lines has led to the premature failures of the hip implant components.
