New England Compounding Center (NECC), Manufacturer of Contaminated Steroids, Seeking Indemnification from UniFirst Corp. Against Claims Stemming From Tainted Steroids Fungal Meningitis Outbreak

UniFirst recently disclosed in a filing with the U.S. Securities and Exchange Commission (SEC) that it had received a letter from NECC asking it to indemnify the compounding pharmacy against fungal meningitis lawsuits stemming from the sale of contaminated steroids. According to the filing, NECC’s request relates to “limited, once-a-month cleaning services” UniFirst provided to “portions of NECC’s cleanroom facilities.” The filing characterizes NECC’s claim as “without merit.”

According to the U.S. Centers for Disease Control (CDC), NECC’s tainted steroid injections have been linked to 656 cases of fungal meningitis and other fungal infections in 19 states, including 39 deaths. NECC recalled all of its products and voluntarily surrendered its license to operate on October 6, 2012. Prior to the recall, the potentially tainted steroids were shipped to 76 facilities in 23 states, the CDC said.

According to a report from NBC News, NECC filed for Chapter 11 bankruptcy protection on Dec. 21, with officials pledging to establish a fund for victim of the fungal meningitis outbreak. Investigation of NECC by the U.S. Food & Drug Administration found extensive contamination at its facility, including fungi in three lots of the steroids linked to the fungal meningitis infections and deaths.

At least 400 fungal meningitis lawsuits have been filed against NECC by alleged victims of the outbreak. In October, Plaintiffs petitioned the U.S. Judicial Panel on Multidistrict Litigation (MDL No. 2419) to establish a consolidated proceeding in a single federal court for all federally filed fungal meningitis claims.
