On Friday, the U.S. Judicial Panel on Multidistrict Litigation (JPML) moved to consolidate the almost 70 physiomesh lawsuits filed against Ethicon Inc. In March, plaintiffs involved in federally filed Physiomesh complaints asked the JPML to consolidate 18 hernia mesh lawsuits for coordinated pretrial proceedings. Since then, the number of Physiomesh Flexible Composite Mesh lawsuits has grown to almost 70 complaints pending in 36 federal district courts nationwide, according to the JPML’s June 2 transfer order. Ethicon opposed centralization due to the individual factual issues involved in each case. The panel rejected the company’s arguments and found common factual questions arising out of allegations that defects in the Physiomesh hernia mesh can lead to complications for implant patients. The JPML also said in its transfer order that the Physiomesh complaints “share paramount issues concerning the design, manufacture, testing, and marketing of a single medical device.” To oversee the Physiomesh multidistrict litigation, the panel assigned U.S. District Judge Richard W. Ethicon’s Physiomesh Flexible Composite Mesh is a large pore, multi-layered device used in minimally invasive ventral hernia repair. The device received 510(k) clearance from the U.S. Food and Drug Administration in 2010. Ethicon voluntarily withdrew Physiomesh in May 2016 after discovering the hernia mesh device had higher rates of revision surgeries and hernia recurrence after a minimally invasive ventral hernia repair compared to other meshes. The company made the discovery after reviewing unpublished data from two large independent European hernia registries. In a letter to health care practitioners, Ethicon said the company believed the higher rates were due to many factors. However, the company “has not been able to fully characterize these factors.” Since Ethicon could not give surgeons further instructions that might lead to a reduction in the recurrence rate, the company decided to withdraw the Physiomesh Composite Mesh from the global market.
