IVC filters are small, cage-like devices designed with struts to trap blood clots and prevent them from traveling to the lungs and causing a pulmonary embolism. The filters are implanted in the inferior vena cava, a major vein that carries blood from the lower part of the body into the heart. Since 2010, the FDA has issued two public safety alerts advising doctors to remove retrievable IVC filters as soon as the threat of a pulmonary embolism has subsided since complications can occur when filters remain implanted longer than necessary.

In 2015, NBC News aired investigative reports that indicated C.R. Bard’s G2 and Recovery filters allegedly causes serious patient injuries or death and the company is aware of problems surrounding its devices. A study published in the Archives of Internal Medicine in 2010 indicated that the failure rate of Bard’s Recovery filter was 25 percent, while the G2 failure rate was around 12 percent. However, the company has never recalled the filters or issued any warnings regarding these risks.

Court documents indicate that parties in the Cook and Bard MDLs are preparing for trials. Three Cook Medical IVC filter lawsuits have been selected for trials to begin in 2017.
