Nexium Lawsuits Allege Proton Pump Inhibitors Cause Kidney Failure, Kidney Damage And Other Injuries Associated With Their Heartburn Drugs.

After asking five drug manufacturers to respond to a petition to consolidate all federal lawsuits involving Nexium and other heartburn medications, the U.S. Judicial Panel on Multidistrict Litigation (JPML) has now scheduled oral arguments on the issue for January. The complaints accuse the makers of Nexium, Prevacid and other Proton Pump Inhibitor (PPI) drugs of failing to adequately warn consumers that their products can cause chronic kidney disease, kidney failure, and renal failure. The JPML will hear oral arguments on January 26 at the Wilkie D. Ferguson, Jr. United States Courthouse in Miami, Florida, according to the judicial panel’s Notice of Hearing Session. In October, a group of plaintiffs involved in Nexium lawsuits filed a motion asking the judicial panel to establish a multidistrict litigation (MDL) for PPI drugs.
While there are 15 PPI complaints pending in 12 federal courts nationwide, plaintiffs said in their motion that they expect lawsuit filings to increase “by the hundreds in the coming months.” PPI drug manufacturers oppose the consolidation for various reasons including the complaints do not have common factual issues as plaintiffs claim. The manufacturers include AstraZeneca, the maker of Nexium; Procter & Gamble which makes Prilosec OTC (Over The Counter), and Takeda Pharmaceuticals U.S.A., Inc., which markets Prevacid and Dexilant. Nexium, also known as “the purple pill,” is in a class of drugs called Proton Pump Inhibitors (PPI). PPI medications reduce the amount of acid in the stomach. The drugs are used to treat stomach ulcers, duodenal ulcers, heartburn, acid reflux disease and other digestive disorders. PPI drugs are available by prescription and over the counter and include familiar brand names such as Prilosec OTC, Prevacid and Zegerid. While PPI drugs are popular among consumers, side effects have been reported that include chronic kidney damage, kidney failure, infection, low vitamin B12 levels, hip, wrist and spine fractures, and renal failure. According to court records, one Nexium case on the proposed MDL list was filed on behalf of a Tennessee man who was prescribed Nexium in July 2003 to treat peptic disorders which include gastroesophageal reflux disease and duodenal ulcer disease. The plaintiff continued taking Nexium through May 2008, when he was diagnosed with a severe, drug-induced kidney disorder called, “acute interstitial nephritis.” In May 2009, he was diagnosed with severe chronic active interstitial nephritis after taking Nexium as prescribed, the complaint said. As a result, the plaintiff is undergoing dialysis treatments three times a week and needs to have a kidney transplant. (Case 2:16-cv-02549, U.S. District Court, Western District of Tennessee)
