The plaintiffs’ request to the U.S. Judicial Panel on Multidistrict Litigation (JPML) seeks to transfer and consolidate 15 lawsuits involving Nexium and other Proton Pump Inhibitor (PPI) drugs. In their October 17th motion to the JPML, plaintiffs said a multidistrict litigation (MDL) for PPI drug lawsuits would grow since they anticipate hundreds of PPI cases will be filed in the future.(Nexium lawsuits In re: Proton-Pump Inhibitor Products Liability Litigation – MDL No. 2757)

The transfer motion suggested federal courts in New Jersey, Kansas, the Southern District of Illinois, the Middle District of Louisiana and the Western District of Louisiana for the Proton Pump Inhibitor MDL. If PPI cases are not consolidated for coordinated pretrial proceedings, the possibility exists for inconsistent pretrial rulings, particularly in regard to discovery and other factual and legal issues, the petition said. Additionally, consolidation is warranted since Nexium and other PPI lawsuits commonly allege that PPI drug manufacturers failed to adequately warn that use of their prescription and over-the-counter drugs can lead to multiple kidney problems. Proton Pump Inhibitors (PPIs) is a class of drugs that treat certain gastrointestinal disorders by reducing the amount of acid in the stomach. Over-the-counter PPIs, including Prilosec OTC, Zegerid OTC, and Prevacid 24HR, are used to treat frequent heartburn. One of the most popular PPIs is Nexium (esomeprazole magnesium), more commonly known as “the purple pill” because of its bright, purple color. Other prescription PPIs include:

• Dexilant (dexlansoprazole)
• Prilosec (omeprazole)
• Zegerid (omeprazole and sodium bicarbonate)
• Prevacid (lansoprazole)
• Protonix (pantoprazole sodium)
• AcipHex (rabeprazole sodium)

Side effects have been reported with Nexium and other PPI drugs that include kidney failure, infection, fractures of the hip, wrist and spine, and low vitamin B12 levels (if taken for more than three years).

Court documents indicate that Nexium lawsuits are pending in Illinois, New Jersey, New York, Tennessee and other courts. AstraZeneca, which manufactures Nexium, faced its first lawsuit in May. The complaint was filed on behalf of an Illinois man who was prescribed Nexium in 2006, and suffered kidney failure that required a kidney transplant. The lawsuit alleges the kidney problems were the result of taking Nexium.
