In the latest Nexium lawsuit, the plaintiff said he began taking Nexium in July 2012 correctly as directed and continued taking the medication until April 2015. As a result of his continuous use of Nexium, the plaintiff now suffers from renal failure, according to the complaint. The Nexium lawsuit claims AstraZeneca Pharmaceuticals LP, which manufactures Nexium, misrepresented the efficacy and safety of the medication and knew or should have known about the problems related to Nexium. Nexium is a popular heartburn drug that is known as ‘the purple pill” because of its bright purple color. Nexium is included in a class of drugs called Proton Pump Inhibitors (PPI) that reduce the amount of acid in the stomach. PPIs are used to treat stomach ulcers, duodenal ulcers, heartburn, acid reflux disease, and other digestive disorders. PPI drugs are available over the counter (OTC) and by prescription. Court records involving Nexium lawsuits indicate that plaintiffs have asked the U.S. Judicial Panel on Multidistrict Litigation (JPML) to consolidate all federally filed lawsuits involving Nexium and other PPI drugs and transfer them to one federal court for coordinated pretrial proceedings. Plaintiffs said in their petition that there are 15 Nexium-PPI lawsuits pending in 12 federal courts nationwide, but they expect lawsuit filings to increase “by the hundreds in the coming months.” Drug manufacturers are opposed to consolidating the cases, arguing in their response to the JPML that the issues are “too broad” because of the various prescription and OTC medications involved in the complaints. Drug makers named as defendants in the litigation include:
• AstraZeneca which makes Prilosec and Nexium
• Procter & Gamble, maker of Prilosec OTC
• Takeda Pharmaceuticals U.S.A., Inc., which markets Prevacid and Dexilant
• Pfizer Inc., which sells only OTC PPI formulations
