The most recent Ethicon Physiomesh lawsuit stated the Florida man had a 25 x 15 cm Physiomesh Composite mesh implanted laparoscopically in November 2015 to repair an incisional hernia. The plaintiff began having complications and was forced to undergo a revision surgery in October 2016 to remove the mesh device, according to the complaint. During revision surgery, the surgeon discovered the Physiomesh had recoiled and caused a recurrent hernia, pain, and adhesion complications, the lawsuit said. The plaintiff said he has suffered and will continue to suffer physical pain and mental anguish. The complaint contends that Ethicon represented Physiomesh as a safe and effective product for hernia repair but was defectively designed and manufactured, and not reasonably safe for its intended use in hernia repair. In May, Ethicon, a subsidiary of Johnson & Johnson, notified health care providers that the company was voluntarily withdrawing its Physiomesh Flexible Composite Mesh which received clearance from the U.S. Food and Drug Administration (FDA) in 2010. In its Urgent Field Safety Notice, Ethicon said there were multiple factors involved in the high failure rates of its hernia mesh based on data from the Herniamed German Registry and Danish Hernia Database. An analysis of the data showed higher rates of hernia recurrence and additional surgery with the Flexible Composite Mesh when compared to similar hernia mesh devices. Since Ethicon was not able to give surgeons further instructions that might lead to a reduced recurrence rate, the company decided to withdraw the Physiomesh Flexible Composite Mesh from the market.
