Jury In C8 Water Contamination Lawsuit Trial Awards $10.5 Million In Punitive Damages

DuPont Has Been Ordered To Pay Over $19 Million In Compensatory And Punitive Damages Since C8 Water Contamination Lawsuits Have Gone To Trial.

C8-Lawsuit-Verdict-Jury-AwardA federal jury in the third C8 water contamination lawsuit trial has awarded $10.5 million in punitive damages to the plaintiff. This brings the total awarded to $12.5 million after the initial $2 million in compensatory damages was awarded last month. The plaintiff’s C8 lawsuit is one of 3,500 pending litigation against DuPont after its Washington Works Plant near Parkersburg, West Virginia was found to have released the C8 chemical into the Ohio River contaminating water supplies. C8 water contamination lawsuit allege plaintiffs developed testicular cancer, kidney cancer, thyroid disease and other health disorders after drinking water tainted with the C8 chemical used at the plant to make Teflon.

This is the third C8 lawsuit trial and the third loss for Dupont and second highest since C8 lawsuit bellwether trials began last year. Last July, an Ohio man was found to have developed testicular cancer due to C8 exposure from the contaminated water and was awarded $5.1 million. The jury in that trial also ordered DuPont to pay $500,000 in punitive damages. In October of 2015, another C8 jury ordered DuPont to pay $1.6 million to an Ohio woman after finding she developed kidney cancer from exposure to C8 contaminated water. Two other bellwether cases have been settled.

Plaintiffs in C8 water contamination lawsuits claims DuPont’s Washington Works plant had been dumping C8, also known as perfluorooctanoic acid, into the Ohio River since the 1950s. C8 was used at the plant to make Teflon and other non-stick protective coatings. A class-action lawsuit was filed against DuPont In 2001 on behalf of nearly 70,000 Ohio and West Virginia residents over the C8 discharge into the Ohio River and the public and private drinking water supply. A settlement of the class-action was reached in 2005. The agreement included creating a C8 Science Panel to conduct a study on whether there was a probable link to C8 and a particular human disease. In 2012, the three-member science panel found a probable link between C8 and:

• High cholesterol
• Kidney cancer
• Pregnancy induced hypertension (pre-eclampsia)
• Testicular cancer
• Thyroid disease
• Ulcerative colitis

As a result, residents, former residents, their survivors, or anyone else who consumed water in one of six water districts in Ohio and West Virginia affected by the C8 contamination and who developed one of these six health disorders during the time period specified by the DuPont C8 class-action lawsuit settlement could file a lawsuit against DuPont.

Court documents indicate that 10 C8 water contamination lawsuit trials are scheduled this year. Judge Edmund Sargus Jr., who is managing the C8 litigation, will oversee one C8 trial in St. Clairsville, Ohio that begins on May 1. Nine other federal judges in Cincinnati, Columbus, and Dayton will preside over the remaining back-to-back C8 cancer trials. (In Re: E.I.
