Risperdal Lawsuit Claims Allege Males Who Are Prescribed The Antipsychotic Drug Risperdal Develop Abnormal-Sized Breasts.

This is the fifth Risperdal trial loss for Johnson & Johnson and its Janssen Pharmaceutical unit. The recently tried case is among 1,700 lawsuits pending in the Court of Common Pleas in Philadelphia that contend boys and young men who take Risperdal to treat schizophrenia, bipolar disorder, and other conditions, develop female-sized breasts, a condition known as gynecomastia.(In Re: Risperdal Litigation, Case No. 100300296)

After a two-week trial, jurors on Friday found that Janssen failed to properly warn the plaintiff, his family, and healthcare providers about Risperdal’s gynecomastia side effect. The plaintiff began taking Risperdal in 2003 when he was five years old to treat a psychiatric disorder, according to the lawsuit. A year later, he started to develop abnormal-sized breasts. The complaint accuses Janssen of downplaying studies that found Risperdal causes excessive breast tissue growth in boys. A Janssen spokesperson said the company plans to appeal the jury verdict. Risperdal is an atypical antipsychotic drug used to treat schizophrenia and bipolar disorder in adults and adolescents, and irritability in autistic children and adolescents. The gynecomastia risk is associated with Risperdal because the drug elevates the levels of a female hormone called, prolactin, and the elevation persists the longer the medication is taken, according to Risperdal’s prescribing information.

The U.S. Food and Drug Administration (FDA) initially approved Risperdal in 1993 for adult use only. Yet, Janssen marketed Risperdal for off-label use in children from 1999 to 2005, according to the U.S. Department of Justice (DOJ). The FDA approved Risperdal use in children in October 2006. In November 2013, Johnson & Johnson and Janssen agreed to pay more than $2.2 billion to resolve civil and criminal claims brought by the DOJ for off-label marketing of Risperdal and other drugs and paying kickbacks to doctors and pharmacists who prescribed the drugs.

Court records show that Risperdal cases have been consolidated in a mass tort program in Philadelphia’s Court of Common Pleas, where four trials were already held. In February 2015, a jury awarded $2.5 million to a 20-year-old Alabama man (Case No. A-196444), but separate jurors in March failed to award compensation even though they found Johnson & Johnson and Janssen failed to adequately warn about Risperdal’s side effects (Case No.130301803) In November, another jury awarded $1.75 million to a Maryland man who took Risperdal when he was 9 years old to help with sleeping problems. (Case No. 130401990) The following month, a Wisconsin man who took Risperdal at 11 to treat symptoms associated with Tourette’s Syndrome, was awarded $500,000. (Case No. 130401984)
