The Abilify lawsuits have been filed in state and federal courts on behalf of men and women who allege they were prescribed the antipsychotic medication and developed uncontrollable urges to gamble, eat, shop, and have sex. The alleged Abilify addictions have caused pain, mental anguish, and increased financial debt due to gambling losses and excessive shopping, according to the complaints brought against Abilify’s makers, Bristol-Myers Squibb and Otsuka Pharmaceuticals. In a Case Management Order (CMO) issued May 26, Judge James J.DeLuca selected 11 Abilify cases for case-specific discovery. According to the CMO, discovery is expected to be completed in February 2018. Judge DeLuca, who is managing the consolidated pretrial proceedings for Abilify complaints in Bergen County Superior Court, scheduled the selection of the first case for trial in September 2018 and scheduled the trial for October 2018. Judge DeLuca also plans to coordinate the pretrial proceedings in New Jersey with the matters pending in the Northern District of Florida, where a multidistrict litigation (MDL) was established for Abilify lawsuits filed in federal courts. Abilify (aripiprazole) is an atypical antipsychotic drug approved by the U.S. Food and Drug Administration (FDA) to treat schizophrenia and bipolar disorder. Aripiprazole is in a class of drugs called partial dopamine receptor agonists and works somewhat differently than other medicines in its class, according to the FDA. While most atypical antipsychotics more fully block dopamine receptors in the brain, aripiprazole only partially blocks the activity of these receptors.

In May 2016, the FDA warned that compulsive urges to gamble, binge eat, shop, and have sex have been reported with the use of aripiprazole, which has brand names of Abilify, Abilify Maintena, Aristada, and generics. The compulsive behaviors stopped after individuals stopped taking the medicine, the FDA said. Although pathological gambling was already listed as a reported side effect, the FDA added new warnings about all of the compulsive behaviors to the drug labels and patient Medication Guides for all aripiprazole products.

An Abilify gambling complaint filed in Bergen County on behalf of a New Jersey woman claims the woman started gambling and shopping after she was prescribed Abilify in 2014. According to the complaint, the woman stopped taking Abilify in 2016, but had already lost over $10,000 due to gambling and shopping. (Case No. BER-L-2739-17, Superior Court of New Jersey, Bergen County) Since compulsive gambling is central to Abilify cases, U.S. District Judge M. Casey Rodgers, who is managing the Abilify MDL in Florida, plans to hold a hearing on whether Abilify causes impulse control disorders.
