The lawsuits claim IVC filters used to trap blood clots have design defects that cause the devices to break, tilt, migrate, puncture the inferior vena cava and fail to prevent blood clots from reaching the lungs.

The JPML’s statistics report shows the number of IVC filter lawsuits for Cook Medical’s Celect and Günther Tulip IVC filters rose from 1,225 to 1,371, from December 15 to January 17. A multidistrict litigation (MDL) for Cook Medical’s IVC filter lawsuits has been established In the U.S. District Court, Southern District of Indiana. IVC filters are small cage-like devices implanted in a large vein, called the inferior vena cava, that carries blood from the lower part of the body to the heart. IVC filters are used to trap blood clots and stop them from reaching the lungs. Some IVC filters are retrievable and can be removed when patients are no longer at risk for pulmonary embolism, a blood clot in the lungs. IVC filters are implanted in patients at risk for pulmonary embolism or when blood thinners cannot be used or are ineffective.

The use of IVC filters has been increasing over the past 30 years and is expected to continue, according to the U.S. Food and Drug Administration (FDA). Along with the increase comes problems with IVC filters. The FDA has received 921adverse events reports involving IVC filters since 2005. Most problems involved the IVC filter migrating from its original place of implantation. There were also reports of the filter’s components detaching and the filter perforating the inferior vena cava. The FDA recommends removing retrievable IVC filters as soon as the pulmonary embolism risk subsides.

Court documents indicate the first IVC filter trial for C.R. Bard is scheduled in the Fall. A trial date has not been set. In October, U.S. District Judge David G. Campbell, who is presiding over the Bard MDL, directed plaintiffs and defendants to select six potential IVC filter cases for trial by April.
