Bard over its Inferior Vena Cava (IVC) filters, NBC News reported that Bard knew in 2004 about the high failure rate of its Recovery IVC filter but continued to sell the device. IVC filter side-effects lawsuits filed against Bard make similar claims that the company’s Recovery and G2 filters fail due to the devices migrating in other parts of the body, fracturing, tilting, puncturing the heart and lungs, and perforating the inferior vena cava. When the filters fail, the IVCs do not stop blood clots, the complaints say.

According to the NBC News investigation, Bard hired an outside consultant doctor to conduct a confidential study on its Recovery IVC filter. The doctor concluded that the device tends to fracture and migrate and further investigation into those problems with the Recovery filter “is urgently warranted.” NBC News reported that Bard sold about 34,000 Recovery filters for nearly three more years before replacing them with a modified version called, G2.

IVC filters are small, cage-like devices that are implanted into a major blood vessel that returns blood to the heart, called the inferior vena cava. The filters, used in patients at risk for pulmonary embolism, are designed to catch blood clots before they can travel to the heart and lungs. Retrievable filters, like Bard’s Recovery and G2 devices, are meant for temporary use, and should be removed once the blood clot threat has passed. The U.S. Food and Drug Administration (FDA) recommended that doctors remove IVC filters as soon as possible as leaving the devices in place increases the risk of serious complications.

Due to the increasing number of lawsuits filed against C.R. Bard over its Recovery and G2 IVC filters, a federal multidistrict litigation was created in August in the U.S. District Court, District of Arizona. More than 50 Bard IVC claims were consolidated for coordinated pretrial proceedings, but more IVC lawsuits are expected to be added to the litigation. A Bard IVC lawsuit transferred into the MDL in ctober involved a Georgia woman who had a G2 Express filter implanted in February 2008. The woman alleges that she discovered in January 2014 that a component of her IVC had perforated a heart muscle and she underwent open-heart surgery to remove the piece of broken filter. However, another missing piece of filter was never removed and assumed to still be in her body.
